1. The supplier and these terms
“TheWebStore”, “we”, “us” or “our” means TheWebStore, a sole proprietorship operated by Quintin Potgieter. “You” or “client” means the person or organisation requesting or receiving our services. Contact us at info@thewebstore.co.za or +27 67 878 6505. The physical business address and address for service is Unit 22, Shiraz on 10th Complex, 102 Tenth Avenue, Ravenswood, Boksburg, Gauteng, 1459, South Africa. The business operates remotely.
These terms apply together with the specific written quotation, scope, order or statement of work you accept. If a project-specific document conflicts with these general terms, the project-specific document controls for that project. A quotation is open for the period stated in it; if no period is stated, it is open for 14 days. A contract starts when you accept a quotation or order in writing, electronically or by another legally recognised method and we confirm it.
Website descriptions and “from” prices are general information, not a promise that every feature is included at that price. Your accepted quote will identify the scope and total price, including applicable fees, taxes if any, recurring charges, payment schedule, delivery assumptions and cancellation terms.
2. Services and scope
We offer services that may include the following. The exact deliverables are those in your accepted written scope:
- WebGo and WebPlus websites: design, build and launch of business websites; WebGo is generally a focused one-page site, while WebPlus may include up to five dedicated pages and expanded content or SEO structure. Hosting, SSL, domain and DNS services are included only as specified in the current package and quote. The published starting prices are from R399 per month for WebGo and R499 per month for WebPlus. A R150 administration fee is advertised for packages to cover domain registration or migration and DNS configuration; confirm its application and any domain renewal charge in your quote.
- E-commerce: store configuration, product catalogue setup (the published add-on includes 50 products added for you), cart, checkout and payment-gateway integration, subject to the agreed scope. The advertised WebPlus add-on starts at R299 per month; once-off implementation may be quoted where appropriate. Payment-provider fees, transaction charges, paid extensions, licences, shipping services and other third-party costs are separate unless your quote says otherwise.
- Custom development: custom WordPress plugins and features, PHP, React or database work, CRM and other system integrations, Android-based applications or workflows, and related technical services. Projects start at R5,000; final fees depend on the approved requirements and quote.
- Google visibility and SEO: on-page and technical SEO, local search, Google Business Profile, Search Console and related optimisation or monitoring as stated in the quote. SEO work cannot guarantee a particular ranking, traffic level or date of result.
- Google Ads: campaign setup, management and optimisation. The calculator on the website estimates management fees of 20% for monthly budgets from R3,000 to R9,999, 10% from R10,000 to R24,999, and 7% from R25,000 upward. Your quote confirms the applicable fee, minimum budget, campaign scope and whether ad spend is paid directly to Google or handled another way.
- Meta marketing and advertising: Meta campaign management and, where selected, recurring ad creative under Meta Solutions. The website marketing page allocates 85% of budgets up to R4,999 to campaign spend and 15% to management; 88% of budgets from R5,000 to R9,999 to spend and 12% to management; 90% from R10,000 to R49,999 to spend and 10% to management; and 92% from R50,000 upward to spend and 8% to management. Optional creative is currently shown at R500/month for one ad every two weeks, R1,000/month for one ad per week, or R2,000/month for two ads per week. Your accepted quote confirms the applicable allocation and fees; campaign spend, creative fees and platform charges are separate components.
- Graphic design and creative: branding, logos, social media graphics, ad creative, brochures, print materials and other design work, to the extent included in your approved quote.
- Email and newsletter marketing: setup or management of email and newsletter activities only where expressly included in your quote. You are responsible for having a lawful basis to contact recipients and for the accuracy and permissions of your lists.
3. Your responsibilities
You must provide accurate instructions, content, approvals, account access and materials on time; identify one authorised decision-maker; review deliverables promptly; and ensure that you have the rights and permissions needed for text, images, fonts, trademarks, customer data, mailing lists and other materials you supply. You are responsible for the legality, accuracy and suitability of your content, products, claims and business practices.
Where a project processes personal information for you, you must determine and communicate lawful purposes and instructions, give any required notices, obtain consents where required, respond to data-subject requests, and enter an appropriate operator agreement with us. You must not instruct us to process information unlawfully or provide data that is unnecessary for the agreed task.
Delays in receiving materials, access, approvals or decisions may change delivery dates and may require rescheduling. Work outside the approved scope, including additional pages, revisions, features or integrations, requires written approval and may incur additional fees.
4. Delivery, review and changes
The site advertises delivery in under 14 days for website packages. Unless your quote expressly says otherwise, this is a target measured from the later of cleared initial payment and receipt of all required content, access and approvals. It assumes a standard package scope and timely client responses. Custom work, complex content, third-party review or provider delays may take longer; we will communicate material changes to the schedule.
For website packages, you may request changes free of charge within 14 days after launch, as advertised. This covers reasonable corrections and refinements within the agreed scope. New features, substantial redesigns, new content or changes caused by a changed brief are additional work and will be quoted before we proceed.
You must review previews and deliverables and tell us about material issues against the agreed scope. Acceptance does not waive any rights that cannot lawfully be waived under the Consumer Protection Act 68 of 2008 (CPA) or other applicable law.
5. Prices, payment and recurring services
All prices and payment dates will be shown in the quote or order. Published prices are starting prices and may change; the price in your accepted quote controls. The website currently states that a R150 administration fee applies to packages for domain registration or migration and DNS configuration. Domain renewals, paid plugins, advertising spend, payment processing, stock assets and other third-party charges are separate unless expressly included. Any taxes, including VAT if applicable, will be disclosed in the quote.
Invoices are payable by the due date stated on them. If payment is overdue, we may give notice and pause work or suspend a service to the extent permitted by law and the contract. Suspension can affect delivery dates. We will not use this clause to remove rights that the CPA or another law gives you.
Recurring service fees, billing cycle, minimum term (if any), price changes and cancellation notice are set out in the accepted quote or order. Before you accept, check those details and any domain, hosting or renewal charges. Cancellation does not remove amounts properly due for services already supplied or third-party commitments already authorised, subject to applicable statutory cancellation, refund and fixed-term agreement rights. Where the ECTA or CPA gives you a cooling-off or cancellation right, that right applies.
6. Intellectual property and licences
You retain rights to materials you supply and grant us a limited licence to use them to perform the agreed work. Subject to full payment and any third-party licence terms, you receive the deliverable rights or licence described in your quote. If the quote is silent, you receive a non-exclusive, perpetual licence to use the final project-specific deliverables for your own business purposes.
We retain rights in our pre-existing materials, generic components, reusable code, processes, know-how and tools. Open-source software, themes, fonts, stock assets, plugins and other third-party items remain governed by their own licences and may carry separate fees or restrictions. We may identify completed work in our portfolio unless you ask us in writing not to do so before launch, and subject to confidentiality and personal-information obligations.
7. Managed hosting and independent providers
Where hosting is included, TheWebStore manages or coordinates the service through an independent third-party hosting or infrastructure provider. The provider controls its own data centres, networks, hardware, upstream connectivity and parts of the hosting platform. Hosting is subject to provider availability, maintenance, security controls, acceptable-use rules and service terms. We cannot promise uninterrupted access or control the provider’s independent acts, omissions, outages, security incidents or changes.
To the fullest extent permitted by law, TheWebStore is not responsible for loss or interruption directly caused by the independent provider or other infrastructure outside our reasonable control. We will take reasonable steps within our role to communicate material incidents, liaise with the provider, and help restore service. This clause does not transfer or exclude any duty that the law places on TheWebStore, including a duty arising from our own acts or omissions, or any non-excludable CPA, POPIA or other statutory right. The provider remains responsible for its own obligations and conduct.
Hosting includes only the resources, backup frequency, support and retention stated in your package or quote. The site advertises managed hosting and monthly backups for website packages; a backup is a recovery measure, not a guarantee that every change can be restored or that no data can ever be lost. You should keep copies of important content and business records. We will make reasonable efforts to help with restoration, subject to the available backup and provider systems.
You must not use hosting for unlawful content, spam, malware, unauthorised access, infringement, or activity that threatens service security or stability. We may restrict or suspend affected activity when reasonably necessary to protect systems or comply with law, and will provide notice where reasonably practicable.
8. Third-party platforms and integrations
Domains and DNS, Google, Meta, PayFast, Peach Payments, Yoco, CRMs, email/newsletter platforms, APIs, plugins, themes, payment processors and other external services are independently operated. Their availability, approval decisions, fees, data practices, policies and changes are outside our control. You must comply with their terms and maintain any required accounts, permissions, subscriptions and payment methods. We are not responsible for their acts or omissions, except to the extent a loss is caused by our own breach or conduct for which liability cannot lawfully be excluded.
Payment gateways may reject, delay or reverse transactions and may charge processing or transaction fees. We do not hold, control or guarantee settlement of payments unless a separate written agreement expressly says so. Advertising outcomes depend on platforms, audiences, competition, budget, creative and market conditions. No particular sales, leads, reach, ranking or return on advertising spend is promised.
9. Service quality, security and limitations
We will perform contracted services with the care and skill required by law and the agreed scope. We will use reasonable efforts to protect systems and information within our control, but no software, website, hosting environment, email, backup or internet service can be guaranteed error-free or invulnerable. Security depends partly on provider infrastructure, software vendors, account credentials, client devices and user conduct.
Advice, estimates, mock-ups, projections and website content are based on information available at the time and are not a guarantee of business results. Unless we expressly agree in writing, you remain responsible for your legal, tax, financial, regulatory and professional decisions, and for checking that your website claims, privacy notices, terms, product information and marketing materials suit your business.
10. Liability and consumer rights
Nothing in these terms excludes or limits a right, guarantee, warranty, remedy or liability that cannot lawfully be excluded or limited, including applicable rights under the CPA, ECTA and POPIA. Nothing excludes liability for fraud, wilful misconduct, or death or personal injury caused by negligence where such exclusion is unlawful.
Subject to that safeguard, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the contract was made. To the fullest extent permitted by law, TheWebStore’s total liability arising from a project is limited to the amount paid or payable for the affected service during the three months before the event giving rise to the claim. This limit does not apply where the law prohibits it, or to liability for our own deliberate wrongdoing or non-excludable statutory obligations.
You are responsible for losses and reasonable third-party claims caused by materials or instructions you supplied unlawfully or in breach of another person’s rights, except to the extent our own conduct caused or contributed to the loss. The allocation of responsibility in this section is subject to the CPA and other mandatory law.
Any term that limits risk or liability is intended to be brought specifically to your attention before you accept a quote or service order. Ask us if you need clarification before acceptance.
11. Cancellation, suspension and termination
Cancellation of a project or recurring service follows the accepted quote or order and applicable law. Statutory cooling-off and cancellation rights, including those that may apply under ECTA or the CPA, are not removed by these terms. If you cancel, you remain responsible only for amounts lawfully due for work performed, approved expenses and properly authorised third-party commitments, subject to any statutory refund rights.
Either party may end a material breach if the other party does not remedy it within a reasonable written notice period, unless immediate suspension or termination is reasonably necessary for security, unlawful activity or legal compliance. On termination, we will provide paid-for deliverables in the form agreed, subject to outstanding amounts and third-party rights. Domain names, hosting and external accounts may need to be transferred or closed under the relevant provider’s rules and may incur fees.
12. Complaints, governing law and changes
Please first send a complaint to info@thewebstore.co.za with your name, project details and the outcome you seek. We will try to resolve it promptly. These terms are governed by the laws of the Republic of South Africa, and disputes are subject to the competent South African courts, without limiting any consumer’s right to approach a regulator or forum available under law.
We may update these website terms from time to time. Changes apply prospectively from publication and do not alter an existing accepted quote or contract unless you agree or the law allows it. The version provided with your accepted quote or order governs that engagement.
